STEM Fields May Grant Visa Extensions

Those seeking to study in the United States are able to do so by obtaining a visa that shows they are enrolled in an educational program and pursuing a full course of study. There are two types of visas available to students: F-1 or M-1. An F-1 visa applies to full-time students, and should these students also be involved in Science, Technology, Engineering and Mathematics (STEM) studies and employment, they may be eligible for an extension of their student visa to remain in the United States.
Before applying for an extension to stay in the United States, a student must first gain their F-1 visa. In order to obtain an F-1 visa, a student must:
- Be enrolled in an academic, language training, or vocational program
- Be going to a school approved by Immigration and Customs Enforcement
- Be enrolled in full-time study
- Show proficiency in English or show they are working towards proficiency
- Prove they are finically supported throughout their course of study
- Show they are not seeking to move to the United States permanently
Once these factors are proven to Immigrations and Customs Enforcement, a student may obtain a visa allowing them to study in the United States. Should these students be enrolled in STEM studies and seeking employment in these fields, there are opportunities to apply for Optional Practical Training (OPT) programs that can increase their time in the United States by 17 months.
STEM Extensions for F-1 Student Visas
If a student studying in the United States obtains employment in a STEM field, they should look into an OPT extension. In order to be eligible, the student must have studied STEM and their employer must be enrolled in the government program and be willing to report the departure of the student within 24 hours.
The student must file for STEM extension up to 120 days before the end of their post-completion OPT and their authorization for employment will be extended for 180 days. At this point, Form I-765 should be filled out to verify employment by a valid employer.
For foreign students, gaining employment in STEM field following graduation can open the doors for work experience, permanent job offers, and the opportunity to obtain a long-tern work visa or permanent residency in the United States.
If you are wondering if the STEM OPT extension is right for you, consult with an immigration attorney. Many of these forms are time-sensitive, and a lawyer can ensure that you are well-prepared when filling these out.
